You’re probably used to seeing messages all over TV and the internet telling you to “Act now. Time is running out.” But in this case, it’s really true. If you’ve been served with a debt collection lawsuit, you don’t have long to file an Appearance in a debt collection case.
If you don’t appear by the deadline, the debt collector will get what’s called a “default judgment.” That means that the debt collector wins—just because you didn’t show up, or didn’t show up on time.
Default judgments are serious business. They give the debt collector the right to garnish your wages, freeze your bank account or put a lien on your home to pay the judgment. Also, in Illinois, the debt collector can charge you 9% interest annually on the amount of the judgment and a judgment can last for 20 years. That means a $3,000 judgment could cost over $10,000 in 15 years.
So, how can you stop a default judgment from happening? Show up. And, better yet, hire a lawyer to represent you. People who hire attorneys in debt collection cases are much more likely to have their case dismissed.
